This License Agreement (the "Agreement") is entered into by and between Static.run ("Provider," "We," or "Us") and the user ("User" or "You") of Static.run's services. By accessing or using Static.run’s services, including all related content, features, and tools (collectively referred to as the "Service"), you agree to be bound by the terms and conditions outlined in this Agreement. If you do not agree to these terms, you must not access or use the Service.
1. Definitions
- "Service" refers to the static hosting platform and associated services offered by Static.run, including website hosting, domain management, SSL certificates, traffic analytics, and any other features provided by Static.run.
- "Content" refers to any materials, data, code, images, text, videos, or other information uploaded, posted, or made available by the User via the Service.
- "User" refers to any individual or entity who registers for and uses the Service, including customers, clients, and guests accessing the Service.
2. Permitted Use of the Service
Subject to the terms of this Agreement, Static.run grants you a limited, non-exclusive, non-transferable license to access and use the Service for lawful purposes and in accordance with the subscription plan you selected.
Permitted Use:
- Host and deploy static websites, applications, and related content.
- Manage domains, SSL certificates, and traffic for hosted websites.
- Use provided APIs, dashboards, and tools to administer your websites and projects.
Prohibited Use:
- Violate any applicable laws or regulations.
- Use the Service to host or distribute malicious software, spam, or any content that violates the rights of others.
- Engage in any activity that interferes with or disrupts the regular operation of the Service, including, but not limited to, sending excessive requests to the Service's infrastructure.
- Utilize the Service for activities that may result in significant legal or financial liability for Static.run.
3. Ownership Rights and Intellectual Property
- Static.run Ownership: Static.run retains all rights, title, and interest in and to the Service, including all intellectual property rights, software, code, and underlying technology.
- User Content Ownership: As a User, you retain ownership of the Content you upload to the Service. However, by using the Service, you grant Static.run a worldwide, royalty-free, non-exclusive license to host, display, and distribute your Content as necessary to provide the Service.
- No Ownership Transfer: Nothing in this Agreement grants you any ownership or rights to Static.run’s intellectual property, except for the limited right to use the Service in accordance with this Agreement.
4. Acceptable and Prohibited Use
Acceptable Use:
- You may use the Service to create, manage, and host static websites for personal, educational, or commercial purposes as long as the usage complies with the guidelines outlined in this Agreement.
Prohibited Use:
- Hosting, transmitting, or storing content that infringes upon the intellectual property, privacy, or other rights of third parties.
- Uploading or distributing malware, viruses, or any other content designed to disrupt or damage other systems or networks.
- Use of the Service for any activity that could cause harm to Static.run's infrastructure or any third-party service provider.
5. Termination Conditions and Consequences
Termination by User:
- You may terminate your use of the Service at any time by discontinuing the use of the Service and notifying Static.run of your intent to cancel your account. Depending on your subscription plan, you may be entitled to a refund as specified in the Refund Policy.
Termination by Static.run:
- Static.run may terminate or suspend your access to the Service immediately if you breach any of the terms in this Agreement. In such cases, Static.run may not provide a refund for any unused portion of your subscription.
Consequences of Termination:
- Upon termination, all rights granted to you under this Agreement will cease, and you will no longer have access to the Service or any associated Content unless otherwise specified.
- Static.run may, at its discretion, retain a copy of your Content for compliance or legal purposes, but is under no obligation to maintain or provide access to terminated accounts.
6. Warranty Disclaimers and Limitations of Liability
- No Warranty: Static.run provides the Service "as is" and "as available," without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Static.run does not guarantee the accuracy, reliability, or availability of the Service.
- Limitation of Liability: Static.run’s total liability to you for any claim arising out of or relating to this Agreement will be limited to the amount you paid for the Service in the 12 months preceding the event giving rise to the claim.
- Indemnification: You agree to indemnify and hold harmless Static.run from any third-party claims, losses, or damages arising out of your violation of this Agreement or the use of the Service in violation of applicable laws.
7. General Provisions
- Governing Law: This Agreement is governed by the laws of the jurisdiction in which Static.run is registered, without regard to its conflict of laws principles.
- Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remainder of this Agreement will remain in effect.
- Amendments: Static.run reserves the right to modify this Agreement at any time. Users will be notified of significant changes, and continued use of the Service constitutes acceptance of the revised terms.
- Entire Agreement: This Agreement constitutes the entire understanding between you and Static.run and supersedes all prior agreements or discussions regarding the Service.
